IMPORTANT: WE ARE AN INSURANCE BROKER, NOT AN INSURANCE COMPANY. READ ALL DISCLAIMERS CAREFULLY.
These Terms of Service (Terms) govern your use of the website and services provided by Insurance with Richard, LLC (Insurance with Richard, we, us, or our). By using our website or services, you agree to these Terms and our Privacy Policy.
1. Our Role as an Insurance Broker
WE ARE A BROKER, NOT AN INSURER. Insurance with Richard is an independent insurance broker. We are NOT an insurance company. We do not underwrite, issue, or guarantee insurance coverage. We do not assume any risk of loss. We do not provide insurance protection or pay claims.
Broker Services. As a broker, we provide the following services:
- Help you shop for health and life insurance products
- Obtain quotes from multiple insurance carriers
- Assist with completing insurance applications
- Submit applications to insurance carriers on your behalf
- Provide general information and education about insurance products
Carrier Relationship. We work with multiple insurance carriers nationwide. Once you enroll in a policy, the insurance carrier is responsible for underwriting, issuing the policy, administering coverage, processing claims, and all other aspects of your insurance coverage. You become a customer of the insurance carrier, not of Insurance with Richard.
2. CRITICAL DISCLAIMERS - READ CAREFULLY
NO GUARANTEE OF COVERAGE APPROVAL. WE DO NOT GUARANTEE THAT ANY INSURANCE CARRIER WILL APPROVE YOUR APPLICATION OR ISSUE YOU A POLICY. Insurance carriers make all underwriting and coverage decisions based on their own criteria, guidelines, and business rules. Carriers may deny coverage, offer modified terms, charge higher premiums, exclude certain conditions, or impose waiting periods based on their evaluation of your application and health information. We have no control over carrier underwriting decisions.
NO GUARANTEE OF LOWEST RATES. WE DO NOT GUARANTEE THAT WE CAN FIND YOU THE LOWEST AVAILABLE RATES OR THE BEST COVERAGE OPTIONS. While we work with multiple carriers and strive to provide competitive options, insurance rates vary based on numerous factors including your age, health, location, coverage level, and carrier underwriting guidelines. There may be policies available from carriers we don't represent, direct from carriers, or through other brokers that have different rates or terms.
NOT RESPONSIBLE FOR CARRIER DENIALS OR DECISIONS. INSURANCE WITH RICHARD IS NOT RESPONSIBLE OR LIABLE FOR ANY DECISION MADE BY AN INSURANCE CARRIER, including but not limited to application denials, policy rescissions, coverage exclusions, premium increases, claim denials, benefit limitations, policy cancellations, or any other carrier action or inaction. All such decisions are made by the insurance carrier in accordance with their policies, procedures, and applicable law.
NO FIDUCIARY DUTY. Insurance with Richard does not owe you a fiduciary duty. We are not your agent, legal advisor, financial advisor, or counselor. We are compensated by insurance carriers through commissions, not by you directly. This means we may receive different compensation from different carriers, which could create a potential conflict of interest. You acknowledge and accept this commission-based compensation structure.
INFORMATION FOR EDUCATIONAL PURPOSES ONLY. Any information we provide about insurance products, coverage, benefits, or costs is for general educational purposes only. It is not personalized advice, a guarantee of coverage, or a promise of specific terms. Actual coverage, benefits, premiums, and terms are determined by the insurance carrier and set forth in the policy documents issued by the carrier. You should carefully review all policy documents before enrolling.
QUOTES ARE ESTIMATES ONLY. Insurance quotes provided through our website or by our agents are estimates only. Actual premiums and terms may differ based on the carrier's underwriting review of your complete application and health information. Quotes are not binding on the insurance carrier or on Insurance with Richard.
NO LIABILITY FOR COVERAGE GAPS. INSURANCE WITH RICHARD IS NOT RESPONSIBLE OR LIABLE FOR ANY GAPS IN COVERAGE, LAPSES IN COVERAGE, DELAYS IN ENROLLMENT, OR PERIODS WITHOUT INSURANCE. You are solely responsible for maintaining continuous insurance coverage and ensuring you have adequate insurance protection at all times.
3. Commission Disclosure
How We Are Paid. Insurance with Richard receives commissions from insurance carriers when you enroll in a policy through our services. These commissions are paid by the insurance carriers, not by you. The commissions we receive do not increase the premium you pay. Commission amounts vary by carrier, product type, and policy term.
No Direct Client Fees. We do not charge you any fees directly for our brokerage services. Our compensation comes entirely from insurance carrier commissions.
Potential Conflicts. Because we receive different commission levels from different carriers and products, we may have a financial incentive to recommend certain carriers or products over others. We strive to provide you with suitable options, but you acknowledge this commission structure and potential conflict of interest.
4. Your Responsibilities
Accurate Information. You are responsible for providing complete, accurate, and truthful information in all insurance applications and communications. False, incomplete, or misleading information may result in application denial, policy rescission, claim denial, or policy cancellation by the insurance carrier.
Review Policy Documents. You are responsible for carefully reviewing all policy documents, coverage summaries, and terms provided by the insurance carrier before enrolling. If you have questions about coverage, benefits, exclusions, or limitations, you should contact the carrier directly or consult with a legal or financial advisor.
Timely Payments. You are responsible for paying all insurance premiums directly to the insurance carrier on time. Failure to pay premiums may result in policy cancellation or lapse of coverage. Insurance with Richard is not responsible for collecting or processing premium payments.
Maintain Coverage. You are responsible for maintaining continuous insurance coverage and ensuring your policy remains in force. You should monitor your policy status, renewal dates, and premium payments.
Direct Carrier Relationship. Once enrolled, you have a direct relationship with the insurance carrier for all policy administration, claims, customer service, and other matters. While we may assist with certain issues, the carrier is ultimately responsible for all coverage decisions and policy administration.
5. Online Quoting and Enrollment
Website Functionality. Our website allows you to request quotes, compare coverage options, and complete applications online. You may also work with our agents via phone or email for personalized assistance.
Application Submission. When you submit an application through our website, we transmit your information to the selected insurance carrier for processing. The carrier will review your application according to their underwriting guidelines and notify you of their decision.
Carrier Enrollment Systems. Some carriers may redirect you to their own enrollment platforms to complete your application and provide additional required information, including Social Security Number. These carrier systems are operated by the carriers, not by Insurance with Richard, and are subject to the carrier's terms and privacy policies.
6. Account Access and Client Portals
Carrier Portals. After enrollment, you will access your policy information, view coverage details, file claims, and manage your policy through the insurance carrier's own client portal and website. Insurance with Richard does not operate these portals and is not responsible for their functionality, availability, or content.
Login Credentials. You are responsible for maintaining the security of your login credentials for carrier portals. Do not share your credentials with others.
7. State Licensing and Regulatory Compliance
Licensed Broker. Insurance with Richard is licensed as an insurance broker in the states where we conduct business. We comply with all applicable state insurance regulations, licensing requirements, and continuing education obligations.
Nationwide Operations. We provide brokerage services for health and life insurance products to residents throughout the United States, subject to state licensing requirements and carrier availability in your area.
Regulatory Authority. If you have a complaint about our services, you may file a complaint with your state's insurance department or regulatory authority.
8. Eligibility and Use Restrictions
Age Requirement. You must be at least 18 years old to use our services and apply for insurance.
US Residents Only. Our services are available only to residents of the United States.
Lawful Use Only. You agree to use our services only for lawful purposes and in accordance with these Terms. You will not:
- Provide false or misleading information
- Attempt to defraud insurance carriers or us
- Violate any applicable laws or regulations
- Interfere with our website or systems
- Attempt to gain unauthorized access to our systems
9. Intellectual Property
Our Content. All content on our website, including text, graphics, logos, images, and software, is owned by Insurance with Richard and protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written permission.
Limited License. We grant you a limited, non-exclusive, non-transferable license to access and use our website for the purpose of obtaining insurance quotes and enrolling in insurance coverage.
10. Third-Party Links
Our website may contain links to third-party websites, including insurance carrier websites and enrollment platforms. We are not responsible for the content, accuracy, or practices of third-party websites. Your use of third-party websites is subject to their own terms and privacy policies.
11. Disclaimers and Limitation of Liability
AS-IS SERVICE. OUR SERVICES AND WEBSITE ARE PROVIDED AS IS AND AS AVAILABLE WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
NO WARRANTY OF RESULTS. WE DO NOT WARRANT OR GUARANTEE ANY PARTICULAR RESULT, INCLUDING BUT NOT LIMITED TO COVERAGE APPROVAL, SPECIFIC PREMIUMS, POLICY TERMS, CLAIM APPROVAL, OR ANY OTHER OUTCOME. ALL INSURANCE DECISIONS ARE MADE BY INSURANCE CARRIERS.
LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSURANCE WITH RICHARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO OUR SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR COVERAGE DENIALS, CLAIM DENIALS, POLICY RESCISSIONS, COVERAGE GAPS, PREMIUM INCREASES, LOSS OF COVERAGE, MEDICAL EXPENSES, LOST INCOME, EMOTIONAL DISTRESS, OR ANY OTHER DAMAGES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
MAXIMUM LIABILITY. IN NO EVENT SHALL INSURANCE WITH RICHARD'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED $500.00, REGARDLESS OF THE BASIS OF THE CLAIM OR THE NUMBER OF CLAIMS.
12. Indemnification
You agree to indemnify, defend, and hold harmless Insurance with Richard, its officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of our services
- Information you provide in insurance applications
- Your violation of these Terms
- Your violation of any applicable laws
- Your relationship with insurance carriers
- Any insurance claim, denial, or coverage dispute
13. Dispute Resolution
Governing Law. These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.
Arbitration. Any dispute arising from or relating to these Terms or our services shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Ypsilanti, Michigan. The arbitrator's decision shall be final and binding.
CLASS ACTION WAIVER. YOU AGREE THAT ANY DISPUTE SHALL BE BROUGHT INDIVIDUALLY AND NOT AS A CLASS ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
TIME LIMIT FOR CLAIMS. ANY CLAIM MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER THE EVENT GIVING RISE TO THE CLAIM.
Carrier Disputes. Any disputes with insurance carriers regarding coverage, claims, underwriting decisions, or policy terms must be resolved directly with the carrier according to the carrier's dispute resolution procedures and the terms of your insurance policy.
14. Termination
Our Right to Terminate. We may terminate your access to our services at any time, with or without cause, with or without notice.
Effect of Termination. Termination of our services does not affect any insurance policies you have already enrolled in. Those policies remain in effect according to their terms with the insurance carrier.
15. General Provisions
Entire Agreement. These Terms and our Privacy Policy constitute the entire agreement between you and Insurance with Richard regarding our services.
Modification. We may modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the modified Terms.
Severability. If any provision is found invalid, the remaining provisions remain in effect.
No Waiver. Our failure to enforce any right does not constitute a waiver.
Assignment. You may not assign these Terms. We may assign these Terms at any time without notice.
